During the respondent council’s case stated in the Administrative Court (in respect of statutory nuisance proceedings), the council applied for an extension of time.  The judge considered the application of CPR Rule 3.9 to the case stated, as explained in the cases of Mitchell v News Group Newspapers Ltd [2013] EWCA (Civ) 1537 and Denton v TH White Ltd [2014] EWCA (Civ) 906. He dismissed the application.
