Holdcroft Properties Ltd v. Goodwin Steel Castings Ltd

[2024] EWHC 2471 (High Court, TCC)

The claimants’ complaint was that for some ten years the cars stored outside their showroom had suffered from damage due to corrosion which they believed had been caused by iron dust particles emanating from the foundry (damage estimated at £750,000). The claimants sought interim orders prior to the issue of proceedings in order to obtain documentary information and to be allowed to access to the foundry premises to take samples: had the dust escaped from the foundry, or was there some other cause as the defendant alleged?  The judge made a very limited order for these purposes.
